Welcome to HomeSavvy. By accessing or using the HomeSavvy website, partner resources, printed materials, manuals, or related services, you acknowledge and agree to the following terms.

1. GENERAL INFORMATION

HomeSavvy publishes a printed homeowner manual and sells exclusive advertising placement within it to local service providers. HomeSavvy also provides homeowner information, organizational tools, maintenance guidance, educational content, partner placements, and related printed and digital materials, intended for general informational purposes only.

HomeSavvy does not provide:

  • licensed contracting services;
  • engineering services;
  • legal advice;
  • inspection services;
  • insurance advice;
  • financial advice;
  • professional repair services.

All information provided through HomeSavvy is intended as general homeowner guidance only.

2. HOMEOWNER DISCLAIMER

Homes, systems, materials, climates, maintenance needs, and repair conditions vary significantly.

Any maintenance schedules, suggested routines, timelines, checklists, or guidance provided by HomeSavvy may not apply to every home or situation.

Homeowners are responsible for independently evaluating:

  • contractors;
  • repair decisions;
  • maintenance needs;
  • safety concerns;
  • professional services.

If you are unsure about a repair, emergency, safety issue, or home system concern, contact a qualified licensed professional.

3. FEATURED PARTNERS

HomeSavvy may feature or place local service providers (“Partners”) within its manuals, website, partner resources, or marketing materials.

These Partners are independent businesses and are not employees, agents, or representatives of HomeSavvyHQ LLC. A Partner’s presence in HomeSavvy materials means that Partner purchased advertising placement. It is not a recommendation, endorsement, certification, accreditation, or vetting of that Partner by HomeSavvy.

HomeSavvy does not guarantee:

  • workmanship;
  • service quality;
  • response times;
  • contractor licensing status;
  • insurance coverage;
  • pricing;
  • customer satisfaction;
  • repair outcomes;
  • availability;
  • project results.

Homeowners are solely responsible for independently evaluating and selecting service providers.

4. NO GUARANTEE OF RESULTS

HomeSavvy does not guarantee:

  • prevention of home issues;
  • maintenance outcomes;
  • contractor performance;
  • repair success;
  • home value preservation;
  • savings;
  • lead generation;
  • marketing performance;
  • return on investment.

Use of HomeSavvy materials and services is at the user’s own discretion and risk.

5. INTELLECTUAL PROPERTY

5.1 Ownership

All HomeSavvy branding, manuals, layouts, graphics, website content, designs, logos, workflows, content selection methodologies, and related intellectual property are owned by HomeSavvyHQ LLC unless otherwise stated.

5.2 Exclusive Production

All HomeSavvy printed materials, including the HomeSavvy Home Manual, are produced exclusively by or on behalf of HomeSavvyHQ LLC. No third party, including Partners, is authorized to print, reproduce, copy, scan, or otherwise duplicate HomeSavvy materials in any format without prior written permission from HomeSavvyHQ LLC.

5.3 Restrictions on Use

No portion of HomeSavvy materials may be:

  • copied;
  • modified;
  • redistributed;
  • republished;
  • reproduced;
  • printed;
  • scanned;
  • resold;
  • recreated;

without prior written permission from HomeSavvyHQ LLC.

5.4 No Misappropriation

Users may not, directly or indirectly: (a) reverse engineer, decompile, or attempt to derive the source, structure, or methodology of any HomeSavvy materials; (b) create derivative works based on HomeSavvy materials; (c) develop or attempt to develop any product, service, or material that is substantially similar to or competes with HomeSavvy materials based on access to or knowledge of HomeSavvy intellectual property; or (d) file any application for trademark, copyright, patent, or other intellectual property right that includes, is confusingly similar to, or is based on any HomeSavvy intellectual property.

5.5 Trade Secrets

Certain HomeSavvy materials (including without limitation the structure and methodology of the HomeSavvy Home Manual, partner program structure, pricing methodology, and content selection methodology) constitute trade secrets under the Colorado Uniform Trade Secrets Act and the federal Defend Trade Secrets Act. HomeSavvy takes reasonable measures to maintain the secrecy of this information.

5.6 Equitable Relief

Users acknowledge that HomeSavvy’s intellectual property is unique and valuable, and that any unauthorized use, reproduction, or misappropriation will cause irreparable harm to HomeSavvy for which monetary damages would be inadequate. HomeSavvy shall be entitled to seek injunctive and other equitable relief, in addition to any other remedies available at law or in equity.

5.7 Enforcement

Unauthorized use of HomeSavvy materials may result in termination of access, civil liability, and any additional legal remedies available to HomeSavvy.

6. PRIVACY POLICY

6.1 Information We Collect

HomeSavvy may collect the following categories of personal information, as defined under applicable state privacy laws including the California Consumer Privacy Act (CCPA/CPRA) and the Colorado Privacy Act (CPA):

Identifiers: name, email address, mailing address, phone number.

Commercial Information: products or services considered or purchased, subscription tier, communication history.

Internet or Network Activity: limited technical information automatically recorded by our web hosting provider, such as IP address and browser type. HomeSavvy does not currently use website analytics services, and uses only strictly necessary cookies. See Cookies and Tracking Technologies in Section 6.2.

Sources of Information:

  • Directly from you (when you complete forms or communicate with us);
  • Automatically through our web hosting provider’s server logs and strictly necessary cookies;
  • From service providers assisting with our operations (for example, payment processors).

HomeSavvy may also receive personal information about third parties from its Partners, including customer names, locations, testimonials, and photographs submitted for publication in HomeSavvy materials. Partners are contractually required to obtain that person’s written permission before submitting the content, to retain that permission, and to provide it to HomeSavvy on request.

Business and Commercial Purposes:

  • Operating and improving HomeSavvy’s publications and services;
  • Communicating with users and Partners;
  • Processing payments;
  • Providing customer support;
  • Analyzing usage trends;
  • Complying with legal obligations.

HomeSavvy does not collect “sensitive personal information” as defined under CCPA/CPRA.

6.2 How Information Is Used

Information may be used to:

  • Operate HomeSavvy’s publications and provide our services;
  • Communicate with users and Partners;
  • Process payments and manage subscriptions;
  • Improve website functionality and user experience;
  • Analyze usage trends and website performance;
  • Provide customer support;
  • Comply with legal obligations and enforce our agreements;
  • Prevent fraud and protect the security of our website and systems.

Cookies and Tracking Technologies. The HomeSavvy website currently uses only strictly necessary cookies, which are required for the website to function properly. HomeSavvy does not currently use analytics cookies, advertising cookies, web beacons, pixel tags, or similar tracking technologies, and does not currently use third-party analytics services.

If HomeSavvy begins using analytics, functional, performance, or advertising cookies in the future, this Privacy Policy will be updated to describe those technologies and their purposes before or at the time they are implemented.

Users may control cookies through their browser settings, including blocking or deleting cookies. Note that disabling certain cookies may affect the functionality of our website. Where required by law, HomeSavvy will obtain user consent before setting non-essential cookies.

HomeSavvy does not currently respond to “Do Not Track” browser signals, but honors valid opt-out signals under applicable state privacy laws (such as the Global Privacy Control) where required.

6.3 Information Sharing

HomeSavvy does not sell personal information.

Information may be shared with:

  • service providers assisting with operations;
  • payment processors;
  • legal authorities where required by law.

6.4 Data Security

HomeSavvy takes reasonable measures to protect user information, including:

  • TLS/SSL encryption for data transmitted between users and the HomeSavvy website;
  • Access controls limiting access to personal information to authorized personnel with a business need;
  • Use of third-party payment processors that maintain PCI DSS compliance. HomeSavvy does not store full payment card numbers or bank account credentials on its own systems;
  • Periodic review of vendor and service provider security practices.

No method of electronic transmission or storage is completely secure. HomeSavvy cannot guarantee absolute security of electronic systems or data transmission.

6.5 Data Retention

HomeSavvy retains personal information for as long as necessary to provide its services, comply with legal obligations, resolve disputes, and enforce its agreements.

6.6 Your Privacy Rights

Depending on your state of residence, you may have the following rights regarding your personal information:

Right to Know and Access. Request confirmation of whether HomeSavvy processes your personal information, and request access to that information.

Right to Correct. Request correction of inaccurate personal information.

Right to Delete. Request deletion of personal information HomeSavvy has collected from you.

Right to Data Portability. Obtain a copy of your personal information in a portable and readily usable format.

Right to Opt Out. Opt out of the sale or sharing of personal information, targeted advertising, and profiling in furtherance of decisions that produce legal or similarly significant effects. HomeSavvy does not sell or share personal information, does not engage in targeted advertising, and does not conduct profiling of this kind.

Right to Non-Discrimination. HomeSavvy will not deny services, charge a different price, or provide a different level of service because you exercised any of these rights.

How to Submit a Request. Email support@homesavvyhq.com with the subject line “Privacy Request.” Include your name, the email address associated with your information, and a description of the request.

Verification. To protect your information, HomeSavvy will take reasonable steps to verify your identity before acting on a request. This may include asking you to confirm information already held in our records. HomeSavvy will not fulfill a request it cannot reasonably verify.

Authorized Agents. You may designate an authorized agent to submit a request on your behalf. HomeSavvy may require written proof of the agent’s authority and may separately require you to verify your own identity.

Response Timeframe. HomeSavvy will respond to a verifiable request within forty-five (45) days of receipt. Where reasonably necessary, HomeSavvy may extend that period by an additional forty-five (45) days and will notify you of the extension, and the reason for it, within the initial forty-five (45) day period.

Appeals. If HomeSavvy declines to act on your request, you may appeal by replying to our response, or by emailing support@homesavvyhq.com with the subject line “Privacy Appeal.” HomeSavvy will respond in writing within forty-five (45) days of receiving the appeal, explaining the reasons for its decision. If your appeal is denied, you may submit a complaint to the Colorado Attorney General at coag.gov. Residents of other states may contact their own state Attorney General.

6.7 Children’s Privacy

The HomeSavvy website and services are intended for users eighteen (18) years of age and older. HomeSavvy does not knowingly collect personal information from any individual under the age of eighteen (18). If HomeSavvy becomes aware that it has collected personal information from an individual under eighteen (18), HomeSavvy will delete that information promptly. If you believe a minor has provided personal information to HomeSavvy, contact support@homesavvyhq.com.

7. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

7.1 No Warranties

The HomeSavvy website, the HomeSavvy Home Manual, and all other HomeSavvy materials and services are provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory.

To the fullest extent permitted by law, HomeSavvy disclaims all implied warranties, including the implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.

HomeSavvy does not warrant that its materials or website will be accurate, complete, current, error-free, uninterrupted, or free of harmful components, or that any defect will be corrected. No advice or information, whether oral or written, obtained from HomeSavvy creates any warranty not expressly stated in these Terms.

Some jurisdictions do not allow the exclusion of certain implied warranties, so some of the above exclusions may not apply to you.

7.2 Limitation of Liability

To the fullest extent permitted by law, HomeSavvyHQ LLC shall not be liable for:

  • Property damage
  • Personal injury
  • Financial loss
  • Contractor disputes
  • Repair outcomes
  • Homeowner decisions
  • Service provider actions or omissions
  • Inaccurate third-party information
  • Indirect, incidental, consequential, special, or punitive damages arising from use of the HomeSavvy website, manuals, or related materials

HomeSavvy’s total aggregate liability to any non-Partner user, regardless of the cause of action, shall not exceed One Hundred Dollars ($100). For Partners, liability is governed by the Partner Agreement.

The limitations in this Section 7 apply regardless of the form of action, whether in contract, tort, strict liability, or otherwise, and survive any termination of these Terms. These limitations are a fundamental element of the basis of the bargain between you and HomeSavvy.

By accessing or using the HomeSavvy website, submitting information through any HomeSavvy form, or receiving HomeSavvy printed materials, you acknowledge that you have read, understood, and agreed to these Terms of Use, Privacy Policy, and Disclaimer, including this Disclaimer of Warranties and Limitation of Liability. If you do not agree, do not use the HomeSavvy website or materials.

8. THIRD-PARTY CONTENT

Partner logos, advertisements, contact information, service descriptions, marketing claims, and testimonials appearing in HomeSavvy materials are supplied by the Partner, not by HomeSavvy. HomeSavvy does not verify, investigate, or authenticate third-party content and has no obligation to do so. Publication of Partner content is not an endorsement or adoption of it by HomeSavvy, and is not a representation by HomeSavvy that it is accurate, current, or lawful.

Partners are contractually required to ensure that everything they submit is accurate and substantiated, that they hold the rights to it, and that any testimonial reflects a real customer’s actual experience and was published with that person’s written permission. HomeSavvy is not responsible for inaccurate, outdated, or unsubstantiated information supplied by a Partner.

9. MODIFICATIONS AND VERSIONING

HomeSavvy reserves the right to modify these Terms, Policies, and Disclaimers at any time. Material changes will be communicated through the website or by direct notice to Partners and website visitors.

Each version of this document carries a version number and an effective date, shown at the top of the page. HomeSavvy retains an archived copy of every prior version and will provide the version applicable to you on request, at no charge, by email to support@homesavvyhq.com.

Continued use of the HomeSavvy website or materials after updates constitutes acceptance of revised terms.

For Partners, changes to these Terms are governed by Section 14.8 of the Partner Agreement, which controls over this Section.

10. DISPUTE RESOLUTION

Any dispute arising out of or relating to these Terms shall first be addressed through good-faith written communication between the parties for at least thirty (30) days. If the dispute is not resolved, either party may pursue resolution in the state or federal courts located in Denver County, Colorado, and the parties consent to the personal jurisdiction of such courts.

Notwithstanding the foregoing, HomeSavvy may seek injunctive or other equitable relief under Section 5.6 in any court of competent jurisdiction.

11. GOVERNING LAW

These Terms and Policies shall be governed by the laws of the State of Colorado, without regard to its conflict of laws principles.

12. BILLING AND REFUNDS

HomeSavvy’s paid services are offered exclusively to Partners under a separate written Partner Agreement. HomeSavvy does not sell products or subscriptions directly to homeowners or other website visitors.

Partner billing terms, including subscription fees, onboarding fees, automatic recurring payment authorization, the sixty (60) day early exit window, and the non-refundable nature of all payments, are governed solely by the Partner Agreement and its Schedule A. In the event of any conflict between this Section and the Partner Agreement, the Partner Agreement controls with respect to Partners.

13. SEVERABILITY, WAIVER, AND ENTIRE TERMS

Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, or severed if it cannot be made enforceable, and the remaining provisions will continue in full force and effect.

Waiver. HomeSavvy’s failure to enforce any provision of these Terms is not a waiver of that provision or of any other provision. A waiver is effective only if given in writing by HomeSavvy.

Entire Terms. These Terms, together with any document expressly incorporated into them, are the entire terms between you and HomeSavvy regarding your use of the HomeSavvy website and materials, and supersede any prior version of this document. For Partners, the Partner Agreement and its Schedule A control to the extent of any conflict.
